Pre-Divorce/Separation Checklist – What to Consider

So you have made the decision to Divorce/Separate from your partner. Have you had the conversation about it yet? If not then it is important to get legal advice about where you stand BEFORE you have this conversation so that you can prepare yourself for what is to come. This may affect your entire decision or it may affect the decisions that you are about to make about where you will live, where the kids will live and your finances. If you have already had the separation conversation then you also need legal advice to ensure that you know what your rights and entitlements are so that you can make decisions about where your children will live, how much time they will spend with each of you, who will keep what and who will pay for what. It is crucial not to make decisions without knowing what your rights and entitlements are as it can be hard to (if not impossible to) go back on your word.

WHERE WILL YOU LIVE?

Should you move out of the family home or stay? You should definitely at the very least move into the spare room or ask your partner to. Whether you should stay in the home long-term or move out is a big decision and legal advice should be sought here so that you don’t jeopardise your position.

HAVE YOU GOT ACCESS TO MONEY?

You will need money for things such as legal advice, rental bond if you are thinking of moving out. You will also need to pay for your own expenses (and the children’s expenses) in case your partner stops paying for things or cuts access to bank accounts. Put some money away for these upcoming costs. If you are unable to do this there are other ways. Call us for advice on this.

WHERE WILL THE CHILDREN LIVE?

If you are planning on moving out, move to a place that can accommodate you and the children so that they have somewhere to stay when they spend time/live with you.

DO YOU HAVE EMOTIONAL SUPPORT?

Divorce/Separation can be really tough so a support network is crucial. If you don’t have people to talk to or really need additional help then counselling is an excellent idea to help you through the process. Seeing a counsellor will not jeopardise your time with the children. It is great to see a counsellor to ensure that you are coping mentally with these changes in your life.
